H-1B Visa.

What is an H-1B Visa?
This visa allows specialty workers with a university degree or with years of experience in a certain field to obtain a visa to work temporarily. To obtain this visa it is necessary that the person also have a job offer and the employer must be willing to pay the individual the prevailing wages as dictated by the state.

It is also possible for models to obtain a H-1B visa. It is important to mention that there is an annual cap of H-1B visas. If it is used up, there will be no more H-1B visas available until the following fiscal year.


What is the Process Like?

First, the studies and experience of the person have to be evaluated by an accredited entity with the Immigration Services. Then, the attorney establishes with the State the prevailing wages. Then, the attorney, petitions through the Federal Department of Labor and the Citizenship and Immigration Services.

What is the Period of Stay?
This visa is approved for three years and can be renewed for three more years.

If the employer wants to hire the employee permanently, it can do so by filing an alien labor certification. If it is approved, the individual can apply for permanent residency in the United States . This process is sometimes long, but the person can maintain legal status under an H-1B visa.
